[45] This court is bound by the Rustenburg Platinum Mines Judgment. However in my view the appropriate approach in dealing with this issue is that which was adopted in Toyota SA Motors (PTY) LTD v Radebe & Others (2000) 21 ILJ 340 (LAC) where the court held that, it would interfere with the sanction imposed by a commissioner if the sanction is so egregious that it shocks and alarms the court.
